Unemployment rates fell in majority of US cities (AP)

WASHINGTON ? Unemployment rates fell in roughly two-thirds of U.S. cities last month, despite zero job growth nationwide.

The Labor Department said Wednesday that unemployment rates dropped in 237 of the nation's largest metro areas in August from July. They rose in 103 and stayed the same in 32. That's an improvement from July, when rates fell in 193 areas and rose in 118.

The U.S. economy added no net jobs in August, the least amount of hiring in almost a year. The national unemployment rate remained 9.1 percent for the second straight month.

Businesses pulled back on hiring this summer after the government said the economy barely expanded in the first six months of the year.

But some areas with heavy agricultural economies gained jobs because August also coincides with the start of the harvest, when seasonal work picks up. The recovering auto industry also hired in Detroit, Flint, Mich., and other cities in the Midwest.

Metro unemployment data is not adjusted for seasonal changes.

Most of the cities that reported sharp improvement still suffer from steep unemployment rates.

Unemployment dropped the most last month in Yuba City, Calif., a heavily agricultural area in Northern California. The city's rate fell from 18.6 percent in July to 17 percent last month.

Another big decline was in Modesto, Calif., home of the E. & J. Gallo Winery, the largest winemaker in the world. The rate there dropped from 17.3 percent in July to 16 percent last month.

The unemployment rate in Mansfield, Ohio fell from 11.4 percent to 10.1 percent, mostly because the city added manufacturing jobs.

El Centro, Calif. and Yuma, Ariz. had the highest unemployment rates among cities, at 32.4 percent and 29.4 percent, respectively. They are adjacent counties with heavy farm economies and large contingents of migrant labor. Yuma's rate fell while El Centro's ticked up.

Bismarck, N.D. reported the nation's lowest unemployment rate, at 3 percent. Lincoln, Neb. had the next lowest rate, at 3.6 percent, followed by Fargo, N.D., at 3.9 percent.

Air Force employee resigns over alleged spy ring

WASHINGTON?? A man accused of running an illegal contractor spy ring in Afghanistan has resigned from the Air Force, still maintaining his innocence, and still facing possible criminal charges.

Two investigations continue in a case that has tested the definition of what contractors are allowed to do in war zones.

Air Force civilian employee Michael Furlong, together with his boss, Mark Johnson, resigned in July after the Air Force inspector general told the men they'd face official censure for how they ran an information-gathering network in Afghanistan.

"After 17 months of DOD investigations and an FBI investigation, it was determined that no criminal laws were broken," Furlong wrote in his August 12 resignation letter, obtained by the Associated Press.

But inquiries continue by the U.S. Air Force Office of Special Investigations and the Pentagon's Defense Criminal Investigative Service, a senior defense official said, speaking on condition of anonymity to discuss matters still under legal review.

The CIA alleged in late 2009 that Furlong's private military contractors were running an illegal covert spying network in Afghanistan and Pakistan, managed by legendary ex-spymaster Duane R. Clarridge. The then-CIA station chief complained those contractors were helping target terrorists for capture and kill operations, and getting in the way of agency operations on the ground, according to multiple U.S. officials briefed on the investigation. All officials spoke anonymously to discuss intelligence matters.

A series of reports by The New York Times first exposed the controversy, leading then-Defense Secretary Robert Gates to order a review. A Defense Department inquiry dated June 2010, obtained by the AP, concluded Furlong's "Information Operations Capstone" had hidden clandestine spying activity beneath layers of legitimate information collection, violating Pentagon policy and leading to the more in-depth investigations.

Furlong and Clarridge maintained to investigators that they were operating a legal network of paid informants, gathering data on everything from gas prices and local clan disputes to enemy threats against coalition forces. The information was used for everything from mapping tribal loyalties to tracking Taliban bomb-building cells before they could strike, two defense officials said, describing the inquiries.

Clarridge said what he did was no different than what a foreign news network would do, using a system of freelance local stringers across the country to gather information.

Under the Furlong-Clarridge system, a handful of five to six foreigners ? former CIA and special operations officers with experience gathering intelligence ? ran a network of low-level local operatives, who asked people what they thought or worked their own sources, as directed by their "handlers."

The problem with information gathering done by a contractor is that the Rolodex of sources becomes an asset of a private company instead of the unquestioned property of the U.S. government, officials said.

That creates a loophole in which there is no way to cross-reference those human sources with existing military and CIA networks on the ground, a crucial step in assessing the veracity of information, and in making sure the same spies or tipsters aren't double-dealing to two arms of the U.S. government, or getting in the way of each other's operations, two former intelligence officials said. They spoke on condition of anonymity to describe a classified process.

That issue became especially prickly for the CIA when Furlong's network started reporting threat information to the military, which Furlong says led to targets.

"Most importantly, we saved U.S. and Afghan lives with the 'Force Protection Atmospherics' program," Furlong said in his letter of resignation. "We enabled the separate targeting board process and the Predator operations to be much more successful than they were or have been since they terminated the Atmospherics program. That is verifiable fact."

Defense officials say Furlong and subcontractor Clarridge maintained their information even led to CIA Predator strikes inside Pakistan. The officials insist investigations have not proven a link between data gathered by Clarridge's network and GPS coordinates of known U.S. drone strikes in Pakistan.

Grey areas
In his resignation letter, Furlong does note that his operation was caught in a gray area of intelligence operations, and he said he welcomed the changes in oversight that had since been put in place.

Those changes included the restructuring of how contractors gather what is known as "atmospherics," like the tone of Friday sermons at a mosque, or the mood on the street of a village toward a local official or NATO. The paid tipsters, still employed by U.S. contractors, now collect information passively, by observing and sharing what they've heard on the street.

Those changes came too late for at least one of the other contractors Furlong employed under his multi-armed intelligence network. Tampa-based International Media Ventures (IMV) shut its doors, turned radioactive by association with the investigations, even as high-ranking Pentagon officials praised IMV's work gathering social and civil data to map Afghan society ? work that is now being carried out by another contractor.

Another one of the firms involved, Strategic Influence Alternatives, went back to the business of protecting corporate executives overseas.

Clarridge is now shopping his human-intelligence networking skills to other foreign intelligence agencies, and to U.S. agencies like the FBI, the defense officials say. Clarridge would not comment for this story.

Defense officials said Furlong told investigators he is confident he'll be cleared.

From the original list of nominees, the selection committee will choose 25 semifinalists in November. That group of semifinalists will be further reduced by a mail ballot to 15 modern-era finalists and announced in early January.

Between four and seven enshrinees will be announced on Feb. 4, and will be inducted in August.

LOS ANGELES (Reuters) ? Revamped comedy "Two and A Half Men" helped CBS become the most watched U.S. TV network for the third straight opening week of the new season, but Fox was tops with 18-49 year-old viewers, television ratings showed on Tuesday.

CBS ended the key debut week with a leading 12.1 million average viewers in primetime, followed by ABC with 9.9 million, Fox at 8.4 million and NBC luring 7.5 million, media research company Nielsen said.

Despite a lukewarm reception for its high-profile "X Factor" singing contest, Fox found a hit with comedy "New Girl," starring Zooey Deschanel, and for the first time won the premiere week among viewers 18- to 49-years-old, a key demographic group that is coveted by advertisers.

CBS was second among 18-49 year-olds, ABC third and NBC fourth.

NBC, seeking to rise from its bottom place under new owners Comcast Corp, found little love for some of its new shows. Its controversial drama "Playboy Club" started poorly last week with 5 million total viewers, and audiences dropped off to 3.9 million for Monday's second episode.

Both Fox and ABC increased their overall audience compared to last year's premiere week. ABC grew 3 percent thanks to large audiences tuning-in to its Emmy-winning comedy "Modern Family", new drama "Revenge" and crime series "Castle", while Fox was up 28 percent in overall viewers.

Stocks gains on Europe, Accenture rises late (Reuters)

NEW YORK (Reuters) ? Stocks rose for a third day on Tuesday on efforts by euro-zone officials to solidify the region's rescue fund and alleviate a sovereign debt crisis, boosting optimism.

But equities ended off their highs for the day after a report suggested cracks were emerging in a previously agreed deal to tackle the crisis.

A successful solution to Europe's sovereign debt crisis would take the pressure off banks worried about funding and remove a threat to economic growth. Rising hopes for an agreement have helped push the S&P 500 up more than 4 percent since Thursday's close.

That's the biggest three-day percentage gain by the S&P 500

since mid-August. So far this week, the CBOE volatility index is down more than 10 percent.

"It's great to see some steps toward resolution. Shoring up banks and dealing with the region's fiscal issues is a real positive for equities," said Malcolm Polley, president and chief investment officer of Stewart Capital Advisors in Indiana, Pennsylvania.

The Dow Jones industrial average finished up 146.83 points, or 1.33 percent, at 11,190.69. The Standard & Poor's 500 Index was up 12.44 points, or 1.07 percent, at 1,175.39. The Nasdaq Composite Index was up 30.14 points, or 1.20 percent, at 2,546.83.

The S&P materials index was up 2.1 percent and an S&P index of energy stocks added 1.5 percent as commodity prices rallied on hopes of a solution in Europe. Mining and energy shares were the top performers among large-cap stocks.

While European officials have considered various approaches to maximize the bailout fund and to recapitalize banks, substantial political hurdles to sealing the deal remain.

The Financial Times reported a split was developing in the euro zone over the terms of the next bailout for Greece. However, this had been reported earlier in the day.

German and French government economic advisers urged in a joint article on Tuesday that Greece be allowed to write off around 50 percent of its debt and called for support for banks with large Greek holdings.

Market volatility could remain high as traders react to headlines and attempt to gauge the commitment of governments and institutions as they work to prevent a Greek default. U.S. equities have been highly sensitive to Europe's debt issues in recent weeks.

"If there was no resolution, that would create a capital hole which would put more pressure on the global financial system and make things worse here," Polley said.

The S&P has gained 3.4 percent so far this week, after losing 6.5 percent on European-led fears the previous week. That week was also the Dow's worst since October 2008 during the thick of the financial crisis.

Stocks also got a boost as investors rebalanced their portfolios in the last days of the quarter. The wide gap in performance between equities and bonds, favoring government debt so far this quarter, may partly reverse.

"All these end-of-quarter issues are amplifying the moves that we've been seeing in stocks," said Paul Simon, chief investment officer at Tactical Allocation Group in Birmingham, Michigan. "I don't have a lot of faith in the moves we've been seeing."

Accenture Plc, a tech services company, rose 3.5 percent to $55.55 in extended trading after the market's close and it reported quarterly earnings that beat expectations. The company gave a 2012 outlook that topped consensus forecasts.

Payroll processor Paychex Inc rose 1.9 percent to $27.20 after the closing bell following stronger-than-expected earnings.

U.S.-listed shares of Research in Motion surged on market speculation that investor Carl Icahn had taken a stake in the BlackBerry maker. The stock was one of the top gainers in the Nasdaq 100, climbing 4.5 percent to $22.65.

Walgreen Co fell 6.3 percent to $33.77 after it signaled that it wouldn't budge in its battle with Express Scripts Inc over what the pharmacy benefits manager will pay for prescriptions. Express Scripts rose 0.9 percent to $39.68.

Almost five stocks rose for every one that fell on the New York Stock Exchange, while about 73 percent of Nasdaq issues ended in positive territory. About 9.04 billion shares traded on the New York Stock Exchange, the American Stock Exchange and Nasdaq, above last year's daily average of 8.47 billion.

"We are modeling for second-half 2011 iPad unit [shipments] of 22 million -- up 91 percent year over year from 11.5 million in the second half of calendar year 2010," Murphy said in an email.

According to Piper Jaffray, prior analyst calls based on sell-in or supply-chain data have, for the most part, proven to have very little correlation with Apple's results in the past.

"Apple purposely maintains enough suppliers and manufacturing partners to make any one supply-side data point inconclusive," Munster and Murphy explained. "For example, Apple is currently transitioning to Brazilian iPad manufacturing, which may be impacting Asian manufacturing numbers."

A Mixed Blessing for Android

Gartner expects that Apple's iPad will command a 73.4 percent share of the global tablet market this year by shipping 46.7 million iPads -- an estimate that is considerably higher than what financial analysts now expect. By contrast, Gartner expects Android-based tablets to only account for 17.3 percent of the global tablet market this year.

On Thursday, Gartner reduced its Android OS tablet forecast for the remainder of 2011 by 28 percent in comparison with the research firm's midyear projections.

"So far, Android's appeal in the tablet market has been constrained by high prices, weak user interface and limited tablet applications," said Carolina Milanesi, research vice president on Gartner's mobile-devices team.

NEW YORK (CNN) -- Seven decades after Nazi forces looted the National Museum in Warsaw during World War II, two paintings by treasured Polish artist Julian Falat were repatriated in a ceremony Thursday night, according to a statement from the Immigration and Customs Enforcement agency.The cultural artifacts were returned to Polish President Bronislaw Komorowski during the event at the Polish Consulate in New York City.Komorowski presented the Presidential Medal to ICE Special Agent Lennis Barrois and retired Special Agent Bonnie Goldblatt in honor of their investigative work leading to the paintings' repatriation, said ICE spokesman Lou Martinez.The oil-on-panels by Falat (1853-1929), both winter scenes, "are two magnificent and very important pieces of art," said Bogdan Zdrojewski, minister of culture and national heritage, in an official statement."Off to the Hunt" which features bundled hunters against a snowy woods backdrop, was originally displayed at the Society for the Encouragement of Fine Arts in Warsaw November 1901 before it was sold to a private owner, given back to the society, and then transferred to the Polish National Museum in December 1939, the ICE news release stated."The Hunt," a wintry panorama with a sun-kissed glaze, was originally owned by Ludwik Norblin before it was endowed to the same fine arts society, and later moved to the national museum, the ICE news release stated.Germany invaded Poland in September 1939, and during the occupation of Warsaw the paintings were taken.The paintings were missing until 2006, when they were discovered by Polish officials at an auction in New York, according to the ICE press release.A complaint filed in federal court last December claimed they were taken from the national museum by Benne Von Arent, an SS lieutenant colonel, in 1944, according to press release from Manhattan U.S attorney's office."No one can ever provide just compensation to the victims of the Nazis' atrocities, but it is very gratifying for our office to play a role in returning the art that they looted during World War II to its rightful owners," New York U.S. Attorney Preet Bharara said in a statement.Since 2007, the U.S. customs agency has repatriated more than 2,500 items to more than 22 countries.CNN's Kristina Sgueglia contributed to this report.

Jaycee Dugard sues U.S. over monitoring of her captor (Reuters)

SAN FRANCISCO (Reuters) ? Kidnap victim Jaycee Dugard on Thursday sued the federal government and accused it of failing to monitor the felon who grabbed her off a Northern California street as a child and held her for 18 years.

Her captor, Phillip Garrido, was sentenced in June to 431 years to life in prison after pleading guilty to kidnapping and multiple counts of sexual assault, in a case that resulted from his arrest in 2009 and the stunning rescue of Dugard.

Garrido, who kidnapped Dugard in 1991 when she was 11, had previous federal convictions dating to 1977 for kidnapping and forcible rape in a case stemming from his abduction of a woman in the Tahoe area of Northern California whom he took to Reno, Nevada.

He was sentenced to 50 years in prison, but was released early on parole in 1988 after serving less than 11 years, Dugard's attorneys state in their lawsuit.

Her attorney Dale Kinsella said in a statement that from December 1988 to March 1999 federal parole agents "failed on numerous occasions to properly monitor" Garrido.

"We believe that the years of abuse experienced by Ms. Dugard are a direct result of the U.S. Parole Commission's colossal blunders in the supervision of Mr. Garrido," Kinsella said.

A spokesman for the U.S. Department of Justice declined to comment on the lawsuit.

The suit was filed in San Francisco in U.S. District Court for the Northern District of California.

In particular, the lawsuit states that parole officers failed to follow up on accusations of sexual harassment made against Garrido in 1989 by a co-worker and other women at the nursing home where he was employed.

And Garrido tested positive for drugs multiple times during his first year-and-a-half under federal supervision, but that was not reported to the Parole Commission despite its "zero tolerance" for drug use by parolees, the lawsuit states.

SNATCHED FROM STREET

The suit also says that parole officers, despite being required to conduct monthly personal check-ups with Garrido, failed to visit his home in 1990, 1992 and 1994.

Dugard was snatched from a street near her South Lake Tahoe home on June 10, 1991, as she walked to a school bus stop. After nearly two decades, she was discovered living with Phillip Garrido and his wife, Nancy, in 2009.

Garrido kept Dugard against her will, hiding her for much of that time in a squalid compound of tents and sheds behind his Northern California home, fathering two girls with her when she was still a teen.

Dugard's family received a $20 million settlement in 2009 through a state victims' compensation fund.

The California inspector general found the California Department of Corrections and Rehabilitation failed to properly supervise Garrido starting in 1999, when his parole case was handed over from federal officials to the state.

Dugard in her lawsuit seeks general damages in an amount to be determined according to evidence presented in court.

Nancy Dugard was sentenced earlier this year to 36 years to life in prison after pleading guilty to one count each of kidnapping and rape by force.
